Terms and Conditions

1. Scope

These Terms and Conditions govern the contractual relationship between Green Canada Farm and clients using our real estate investment advisory, property acquisition, and management services. They apply to all consultations, property evaluations, acquisition assistance, and portfolio management services. By engaging our services or entering into an advisory agreement, you agree to these terms.

2. Services and Contract Formation

The offerings from Green Canada Farm are subject to availability. Service requests or client engagement agreements are only considered accepted after written confirmation from Green Canada Farm. The contract is formed upon receipt of confirmation by the client or when Green Canada Farm begins providing the requested services.

3. Service Description

Our services include real estate investment strategy development, property market analysis, acquisition assistance, property management, and portfolio optimization services. The exact service description is derived from the respective engagement agreement or advisory contract. Market conditions, property availability, and investment timelines in our materials serve as guidelines and may be adjusted to accommodate current market dynamics and client preferences.

4. Payment Terms

Payment for investment advisory and property services is due according to the schedule outlined in your service contract, typically with an initial retainer followed by milestone or success-based payments. For ongoing property management services, monthly fees are typically charged in advance. Payments are made by bank transfer, credit card, or other payment methods specified in your agreement. In case of late payment, we reserve the right to charge interest at the statutory rate and to withdraw from providing further services.

5. Cancellation and Refund Policy

  • Cancellation by the Client:
    • For advisory services - Up to 14 days before scheduled consultation: Full refund of any prepaid fees
    • 7-13 days before: Cancellation fee of 30% of the prepaid amount
    • 3-6 days before: Cancellation fee of 50% of the prepaid amount
    • Less than 72 hours before: No refund available
    • For acquisition services - Cancellation after property search has commenced but before offers have been submitted: 50% of the retainer fee is refundable
    • For property management services - 30 days written notice required; any prepaid fees beyond the notice period will be refunded
  • Cancellation by Green Canada Farm:
    • If a service cannot be provided due to force majeure, unforeseen market conditions, or other circumstances beyond our control, clients will be informed immediately. In this case, payments already made will be fully refunded or, at the client's request, credited toward alternative services.

6. Investment Advisory and Quality

Green Canada Farm conducts all advisory and property services with the highest professionalism, diligence, and expertise. We reserve the right to adjust investment recommendations to best reflect current market conditions and emerging opportunities. For individual consultation appointments, rescheduling is free of charge up to 48 hours before the agreed time. While we provide expert guidance on real estate investments, we cannot guarantee specific returns or appreciation rates as these are subject to market conditions beyond our control.

7. Liability and Investment Risk

Green Canada Farm works according to recognized methods of real estate investment analysis and portfolio management. However, all investments carry inherent risks, and no guarantee can be given for specific returns or performance outcomes. Our advice is based on market data and professional experience, but property investments remain subject to market fluctuations, economic changes, and other factors. Clients acknowledge that they bear ultimate responsibility for their investment decisions. Green Canada Farm's liability is limited to intent and gross negligence in our advisory capacity.

8. Intellectual Property and Usage Rights

All investment strategies, market analyses, property evaluations, and advisory materials are protected by copyright and remain the intellectual property of Green Canada Farm. They are provided to clients for personal use only and may not be reproduced, distributed, or used for commercial purposes without express written permission. Clients commit to maintaining the confidentiality of proprietary investment strategies and market insights shared during our engagement.

9. Confidentiality

Green Canada Farm commits to absolute confidentiality regarding all personal and financial information disclosed during the advisory relationship. Client investment details, portfolio composition, and financial circumstances will be treated with the highest level of privacy. References and testimonials will only be used with the express permission of the clients concerned.

10. Data Protection

Clients' personal data is used exclusively for providing investment advisory services and for client support. Data will only be shared with third parties if necessary for contract execution (such as property managers or legal representatives) or with the express consent of the client. 11. Jurisdiction and Applicable Law

Canadian law applies. The place of jurisdiction for all disputes is the location of Green Canada Farm in Vancouver, Canada.
